Guided Lifestyle & Optimal Wellness reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate fully with Guided Lifestyle & Optimal Wellness in asserting any available defenses. You agree not to settle any such matter without the prior written consent of Guided Lifestyle & Optimal Wellness.

21. Dispute Resolution, Arbitration, and Class Action Waiver

21a. Informal Resolution First

Before initiating any formal legal proceeding, you agree to first contact Guided Lifestyle & Optimal Wellness at legal@lumiintelligence.ai and attempt to resolve any dispute informally. Guided Lifestyle & Optimal Wellness will attempt to resolve disputes informally by contacting you at the email address associated with your account. If the dispute is not resolved within thirty (30) days of informal notice, either party may pursue formal resolution as set forth below.

21b. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except as provided below, you and Guided Lifestyle & Optimal Wellness agree that any dispute, claim, or controversy arising out of or relating to this Disclaimer, the G.L.O.W. web platform, or your use thereof — including questions about the existence, validity, scope, or enforceability of this arbitration agreement — shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law.

The arbitration shall take place in Los Angeles County, California, or, at your election, may proceed via telephone or videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. NO ARBITRATION OR PROCEEDING WILL BE COMBINED WITH ANOTHER WITHOUT THE PRIOR WRITTEN CONSENT OF ALL PARTIES TO ALL AFFECTED ARBITRATIONS OR PROCEEDINGS.

21d. Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent imminent harm, and claims that are within the jurisdiction of a small claims court may be brought in that court. Nothing in this section limits either party's right to bring an individual action in small claims court for disputes within that court's jurisdiction.

21e. Governing Law and Jurisdiction

This Disclaimer and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive personal jurisdiction of the state and federal courts located in Los Angeles County, California.

The inclusion of any link does not imply endorsement by Guided Lifestyle & Optimal Wellness of the linked site or any association with its operators.

When you leave the G.L.O.W. web platform and access a third-party site or service, you do so at your own risk and subject to that site's or service's own terms and conditions and privacy policy. Guided Lifestyle & Optimal Wellness is not responsible for any damages or losses caused or alleged to be caused by or in connection with your use of any third-party site, content, or service.

G.L.O.W. is intended exclusively for users who are 18 years of age or older. By creating an account or using the Platform, you represent and warrant that you are at least 18 years of age.

G.L.O.W. is designed for adults who have undergone or are preparing for cosmetic or plastic surgery procedures. The Platform's Content and AI companion are calibrated for adult users with an established relationship with a board-certified surgeon. Use of this Platform by individuals under the age of 18 is not authorized.

Guided Lifestyle & Optimal Wellness does not knowingly collect personal information from individuals under the age of 18. If Guided Lifestyle & Optimal Wellness becomes aware that a user under the age of 18 has created an account or submitted personal information through the Platform, that account will be suspended and the associated information deleted. If you believe a minor has registered for G.L.O.W., please contact us immediately at support@officialglow.ai.

Companion chatbots, including Lumi, may not be suitable for some minors.

24. User-Generated Content

In a future version of G.L.O.W., users will have the ability to post, share, and interact with content within a community feature on the web platform. The following terms govern all user-generated content ('UGC') submitted to the Platform:

24a. No Endorsement of User Content

Guided Lifestyle & Optimal Wellness does not review, approve, endorse, or guarantee the accuracy of any UGC submitted by users. UGC reflects the views and experiences of individual users only and does not represent the views of Guided Lifestyle & Optimal Wellness or any medical professional. UGC is not medical advice, and users must never rely on UGC as a substitute for professional medical guidance.

24b. No Liability for User Content

Guided Lifestyle & Optimal Wellness expressly disclaims all liability for any UGC posted by users. You understand that by using community features, you may be exposed to content that is inaccurate, offensive, misleading, or otherwise objectionable. Guided Lifestyle & Optimal Wellness is not responsible for any loss, harm, or damage arising from your exposure to or reliance on UGC submitted by other users.

24c. Your Responsibility

Guided Lifestyle & Optimal Wellness reserves the right, but not the obligation, to monitor, edit, remove, or disable access to any UGC that Guided Lifestyle & Optimal Wellness determines, in its sole discretion, violates this Disclaimer, the Terms of Service, or applicable law. Guided Lifestyle & Optimal Wellness does not assume any responsibility or liability arising from its failure to monitor, edit, or remove any UGC.

26. Severability

By creating an account and using G.L.O.W., you explicitly acknowledge, confirm, and agree to each of the following:

• You understand that G.L.O.W. and Lumi provide general educational information only, and that nothing in this Platform constitutes personalized medical advice, diagnosis, treatment, or professional healthcare services.
• You understand that Lumi is an AI system and is not a licensed nurse, physician, or any other healthcare professional.
• You understand that your surgeon's direct post-operative instructions take absolute precedence over any Content provided by this Platform, and you commit to following your surgeon's instructions.
• You agree not to use G.L.O.W. as a substitute for professional medical care, and not to make medical decisions based on Platform Content.
• You confirm that you have or will establish a relationship with a board-certified plastic surgeon or qualified healthcare provider for your actual post-operative care and clinical oversight.
• You agree that in a medical emergency, you will call 911 or go to the nearest emergency room immediately, and not rely on this Platform.
• You acknowledge that Guided Lifestyle & Optimal Wellness is not liable for medical decisions made based on this Platform's content.
• You understand that the Photo Analysis feature, when available, is educational only and not a clinical assessment tool.
• You acknowledge that recovery experiences vary by individual and that Platform content cannot predict your personal outcome.
• You are at least 18 years of age and are authorized to enter into this agreement.
• You agree to the arbitration clause and class action waiver in Section 21 and understand it affects your legal rights.
• You agree to indemnify Guided Lifestyle & Optimal Wellness as set forth in Section 20 for any claims arising from your misuse of the Platform.

If you do not agree to any of the above, you are not authorized to use G.L.O.W. and should exit the Platform now.
